Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the My Size mobile application ("App") developed by WELLPEACH ("Developer", "we", "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

2. Definitions

1. "App" means the My Size application available on the Apple App Store and Google Play Store.
2. "User" means any individual who downloads or uses the App.
3. "Content" means the size conversion data, charts, and brand guides provided within the App.

3. License to Use the App

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on your personal device solely for personal size reference purposes, subject to these Terms. This license does not include the right to:

• Copy, modify, or distribute the App
• Reverse engineer or attempt to extract source code
• Create derivative works based on the App
• Remove copyright or trademark notices

4. Free App & Advertising

1. My Size is free to download and use. There are no paid subscriptions or in-app purchases.
2. The App is supported by advertising provided by Google AdMob. Ads may be displayed within the App during normal use.
3. On iOS, you will be asked for App Tracking Transparency (ATT) consent before personalized ads are shown. You may decline without losing access to any App feature.

5. Size Data Accuracy

1. The size conversion tables are based on publicly available international sizing standards (ISO, KS, EN, JIS, etc.) and are regularly reviewed for accuracy.
2. We make no warranty that the conversion data is free from errors or perfectly matches any specific product or brand.
3. Users are responsible for verifying sizes before making purchases. We are not liable for purchases made based on App data.
4. Brand-specific size guides in the App are provided for general reference and may not reflect the most recent updates from each brand.

6. User Data & Measurements

1. Any body measurements you save in the App (foot length, chest, waist, head circumference) are stored locally on your device only. We do not access, read, or process this data.
2. You are solely responsible for maintaining this data. We are not liable for data loss resulting from device failure, App deletion, or OS updates.
3. Deleting the App removes all locally stored measurements from your device.

7. Intellectual Property

1. The App, including its design, code, graphics, and branding, is owned by WELLPEACH and protected by copyright law.
2. The name "My Size" and associated icons are trademarks of WELLPEACH.
3. Size conversion data presented in the App is compiled from public international standards and is not independently copyrightable by us.

8. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose
• Attempt to exploit, hack, or disrupt the App or its infrastructure
• Scrape, copy, or redistribute the App's size data for commercial purposes
• Use automated tools to interact with the App

9. Service Changes & Termination

1. We reserve the right to modify, suspend, or discontinue any part of the App — including removing it from app stores — at any time, for any reason, without prior notice.
2. If the App is removed from the App Store or Google Play, existing installs on your device will continue to function for core offline features, but updates will no longer be available.
3. We may update the App (including size data, features, and UI) without prior notice. Significant changes will be communicated via in-app notices or this page.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SIZE CONVERSION DATA IS COMPLETE, ACCURATE, OR SUITABLE FOR ANY PARTICULAR PURCHASE DECISION.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ARTHUR KIM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA OR FINANCIAL LOSS FROM PURCHASES MADE BASED ON APP DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. SINCE THE APP IS FREE, OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED USD $1.00.

12. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

13. Changes to Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. Material changes will be communicated via an in-app notice. Continued use of the App after the effective date constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms shall first be resolved through good-faith negotiation. If negotiation fails, the dispute may be submitted to binding arbitration or a court of competent jurisdiction.
